Can I Sue EDD for Damages?

Table of Contents

For many of you who had to deal with the EDD during the Pandemic, you probably experienced extremely long delays, repetitive procedures where you have to verify your identity in multiple ways just to get denied and have to go through an appeal to prove you are who you say you are. Some of you might have been stuck on ‘pending’ status with seemingly no end in sight. While the EDD was certainly taking its time paying your benefits, you may had to take loans and pay interest to pay you monthly obligations. Others had to relocate an incur costs of storage and travel. This caused many people to ask whether they could recoup the costs caused by the EDD’s delays. Unfortunately,
the short answer is probably not. You can hear our founding attorney, Assaf Lichtash, discuss this issue and propose what the solution is:

Let's identify your legal issue.

Are you an Individual or a Business?

Do you have a current claim for benefits?

Is the EDD refusing to pay some or all of your benefits?

Is the EDD refusing to pay because it claims you were overpaid benefits?

Does the EDD claim you owe them money?

What type of benefits are you claiming?
