I was very happy with my experience with Pershing Square Law Center and I highly recommend them! From start to finish, the experience has been excellent. I’m writing this review before receiving the judgment for my EDD appeal case, but I already feel incredibly grateful for my lawyer Charlie’s representation. I know without a doubt that I would have had no chance without him. I was able to speak with Charlie three times before the hearing, and he called me immediately afterward to go over everything. You can tell he is passionate about his work, genuinely a good human being with a good heart and a deep aptitude for what he does. When I first called Pershing Square Law Center, I was assisted right away, and they made it clear that I would be represented on contingency and that I would be not charged a fee directly. The intake process was friendly, concise, and included a brief conversation with the attorney. The intake staff member who handled my call was cordial, clear, and very helpful in completing intake documents. After the intake, I was pleasantly surprised and truly impressed by the responsiveness of the entire team, especially from Alison and Genecis. Every email and voicemail I sent with questions before my EDD hearing was answered clearly and professionally, usually within 24 hours and never later than 48. A unique aspect of my case is that it involved an overpayment appeal rather than a denial of benefits. This meant the potential contingency payout for Pershing Square Law Center was very small. Despite that, the team remained consistently responsive, and at no point did I feel that Charlie and the staff at Pershing Square Law Center treated my case as less important than a case with a larger potential for a payout. While writing this, I noticed some negative reviews. I can only speculate that those may come from people with highly emotional expectations of being guaranteed a big payday. My experience has been nothing but excellent, ethical, and professional from beginning to end. I Thank you, Pershing Square Law Center!

I was originally denied my EDD disability benefits in California, but Pershing Square Law Firm, PC stepped in and filed an appeal. They got my temporary disability benefits approved within 30 days. Every member of the firm I spoke to was very professional, and the team was responsive, kind and really knew the process. I highly recommend them if you’re facing a denial.

I like to thank the Team at Pershing square, Dafne, Assaf, and Daniel for helping me through 2 cases. I owe Assaf a big thanks for winning the PUA case for me years ago and this time Daniel for his excellent guidance with my EDD case. Especially a case that’s classified as voluntary quit ( one of the harder cases to fight). To all the people complaining about how little the attorney does during the hearing you shouldn’t, because in these cases, all the judge really cares about is your testimony and your opponents testimony if there are any, it is not criminal defense stuff. Daniel did a tremendous job helping me prepare and I was nailing the judges questions. At last, thank you guys so much again. This is the end of my dealings with EDD for my lifetime and to all of you reading this, they are absolutely the best reliable attorneys to hire if it is a tough case.

There truly are not enough words to express how grateful I am to Pershing Square Law Firm, especially Charlie, Alexis, and their entire team. They helped me through an incredibly stressful EDD overpayment appeal case that had been weighing heavily on me and my family for a long time. From the very beginning, they treated me with kindness, patience, professionalism, and genuine care. At a time when I felt anxious, overwhelmed, and uncertain about the future, they gave me reassurance, guidance, and confidence throughout the entire process. They never made me feel like just another case. They listened to my situation, believed in me, and fought hard on my behalf every step of the way. Charlie represented me with incredible professionalism and dedication, and Alexis was always responsive, supportive, and compassionate whenever I had questions or concerns. Their communication and commitment truly made one of the hardest situations in my life feel manageable. Thanks to their hard work and persistence, we were able to achieve a positive outcome in my case, which brought an enormous sense of relief to me and my family. Looking back now, the retainer fee was absolutely worth it for the peace of mind, support, and outcome they helped me achieve. If anyone is dealing with an EDD overpayment or appeal issue and wants a team that genuinely cares about their clients, I wholeheartedly recommend Pershing Square Law Firm. I am beyond thankful for everything they did for me. Thank you again to Charlie, Alexis, and the entire team from the bottom of my heart.

If your unemployment claim is denied, you have the right to appeal the decision, and the appeal letter is where you set out why the determination was wrong. This guide will walk you through the key elements of writing a strong appeal letter, along with information sourced from authoritative legal and government resources, including the California Employment Development Department (EDD).

1. Include Critical Information in Your Appeal Letter

You must submit your appeal in writing within 30 days of the mailing date on your Notice of Determination and/or Ruling (DE 1080CZ) or Notice of Overpayment (DE 1444CT). You can still submit an appeal after the 30-day deadline, but you must provide the reasons why you missed the deadline.

To appeal, download the Appeal Form (DE 1000M) or use the copy included with your Notice of Determination or Notice of Overpayment. Mail your appeal form or letter to the address at the top of your Notice of Determination. If you need the mailing address or a copy of your Notice of Determination or Notice of Overpayment, contact Unemployment Customer Service at 1-800-300-5616, send us a message through your UI Online account, or visit an America’s Job Center of California (AJCC) location.

If you choose to write a letter, include all of the following information:

  • Full name
  • Address
  • Phone number
  • Social Security number
  • Name and mailing address of any person representing you
  • The decision you are appealing
  • Details, documents, and evidence supporting your appeal
  • Any request for language assistance or special accommodations

After You File an Appeal

After you submit your appeal, the EDD will review the information you provided. If the information you provided in your appeal does not change the EDD’s decision, we will send your appeal to the California Unemployment Insurance Appeals Board, also known as the Office of Appeals. For information about what to expect at your hearing and how to prepare, please visit the California Unemployment Insurance Appeals Board website.

Second-Level Appeals

If you disagree with the ALJ’s decision, you may file a second-level appeal with the California Unemployment Insurance Appeals Board. Visit Filing an Appeal | California Unemployment Insurance Appeals Board for more information.

2. Clearly Explain Why You Are Appealing

Your appeal letter must be clear, direct, and to the point. Clearly state why you disagree with the unemployment office’s decision. Here are some essential tips:

Identify the Mistake in the Denial

  • Was the denial based on misinterpretation of facts?
  • Did the employer provide false or misleading information?
  • Was there a clerical error in your filing?

Provide a Strong Argument

If you were denied benefits due to alleged misconduct, you need to explain:

  • Why your actions do not meet the legal definition of misconduct.
  • Any mitigating circumstances that prove you were not at fault.

For example, California EDD requires valid reasons to deny benefits. If the denial was unfair, your appeal should highlight the errors made in the initial review process. More details can be found here: How to Appeal a Decision.

3. Provide Copies of Supporting Evidence

To strengthen your appeal, attach relevant documents and evidence to support your claims. Your supporting documents may include:

  • Employment Records (pay stubs, offer letters, work schedules)
  • Written Communication (emails, letters, or messages with your employer)
  • Medical Documents (if you were fired due to health reasons)
  • Witness Statements (colleagues or supervisors who can verify your claims)
  • Company Policies (if you were terminated unfairly despite company policies allowing your actions)

Make sure to submit copies of the original evidence rather than the originals themselves. For further guidance on submitting supporting documents, visit: Appeal Hearing Evidence Submission.

4. Keep Your Letter Concise

Your appeal will be one of many that the caseworker reviews, and they have limited time for each case. In many instances, simplicity is key; it lets the caseworker concentrate on the points the decision actually turns on. Avoid overwhelming your important arguments with irrelevant information that requires the caseworker to sift through your appeal. Avoid including issues such as conspiracy theories, your feelings about the unfairness of the determination, or the fact that you have never applied for unemployment benefits before.

While you need to provide enough detail to support your case, avoid unnecessary length. Keep your letter concise, professional, and structured.

Structure of an Effective Appeal Letter

  1. Opening Statement
    • Mention that you are formally appealing the decision to deny your unemployment benefits.
  2. Briefly Explain the Decision You Are Appealing
    • State the reason provided for denial and why you believe it is incorrect.
  3. Present Your Arguments Clearly
    • Provide only necessary details that support your case.
  4. Attach Relevant Documents
    • Reference the supporting evidence attached with your letter.
  5. Request for Reconsideration
    • Politely request a review and reconsideration of your claim.
  6. Professional Closing
    • Sign off formally with your full name and contact details.

For more tips on effective appeal writing, visit: EDD’s Guide on Writing an Appeal. This resource provides detailed instructions on how to structure your appeal effectively, what information to include, and common mistakes to avoid.

5. Consult an Attorney While Writing Your Appeal

Finally, it is wise to consult an experienced unemployment lawyer, especially if you plan to reference specific laws in your letter. For those seeking assistance, reaching out through online consultations, direct calls, or scheduled meetings with an expert in employment law can provide the necessary guidance to build a strong case.

Seeking professional legal advice when drafting your unemployment appeal letter can significantly increase your chances of success. Attorneys specializing in employment law understand the complexities of unemployment benefits appeal and can help you navigate the legal process effectively.
